Idaho <br />Department of <br />Correction <br /> <br /> <br /> <br /> <br /> <br />Policy <br />Control Number: <br />405 <br />Version: <br />2.0 <br />Page Number: <br />1 of 2 <br />Adopted: <br />3-15-1985 <br />Reviewed: <br />11-2-2012 <br />Next Review: <br />Title: <br />Access to Courts <br /> <br />This document was approved by Brent Reinke , director of the Idaho <br />Department of Correction, on 11/2/12 (signature on file). <br />Open to the public: Yes No <br />BOARD OF CORRECTION IDAPA RULE NUMBER 405 <br />Court Proceedings within a Facility <br />POLICY STATEMENT <br />It is the policy of the Idaho Board of Correction that the Idaho Department of Correction <br />(IDOC) and its contractors develop and maintain an adequate method to ensure offenders <br />have direct access to the courts in order to pursue constitutionally mandated legal actions <br />and qualified legal claims . <br />PURPOSE <br />The purpose of this policy is to communicate the Board’s management philosophy regarding <br />offender access to court matters . <br />SCOPE <br />This policy applies to all procedures created under the authority of this policy and to IDOC <br />facilities, assigned staff, and offenders under the jurisdiction of the IDOC . <br />RESPONSIBILITY <br />The director of the IDOC and chief of the Division of Prisons (in consultation with the chief of <br />the Division of Education, Treatment, and Reentry) are responsible for overseeing the <br />development, implementation, and monitoring of standard operating procedures (SOPs) that <br />provide guidance on or establish, at a minimum, the following: <br />• What qualified legal claims are; <br />• Offender procedures to request access to courts assistance, services, and <br />resources ; <br />• Offender-to-offender assistance guidelines; <br />• Offender procedures for filing pleadings and other documents with a court; <br />• Service of document procedures; <br />• Telephone hearings and attorney telephone calls ; and <br />• Procedures for offenders to store their excess legal materials.
